My son receives Dependency and Indemnity Compensation (DIC) from VA because his father died due to a service-related disability. I’m remarried. Do his benefits change if my new husband chooses to adopt him?
Answer:
Your son will continue to receive his DIC entitlement even if your current spouse adopts him. VA regulations also state that if the adoptive parent is a veteran receiving disability compensation for disabilities rated over 30 percent, then the adoptive parent can also add the child to his or her VA award.
